Public Childcare & Housing Law and Practice
This elective seeks to provide a practical working knowledge of
Public Childcare and Housing Law and Practice, a proper grounding
in the appropriate procedural law and the relevant oral and written
skills. The course is suitable for all those intending to practice
as a solicitor in a High Street private practice, in a local
authority or in an advice centre.
The first half of the course is devoted to the study of Public
Childcare Law and Practice. In the context of practical case
studies, we will address:
- court structure, allocation of proceedings and the rules of
court; the professionals involved
- parental responsibility and section 8 orders; s1 principles;
Part III Children Act 1989 and services to children in need
- the protection of children under Part V Children Act 1989 and
the threshold criteria
- care proceedings under Part IV Children Act 1989, the course of
proceedings and the public law outline, care planning; care/contact
for look-after children
The second half of the course is devoted to the study of Housing
Law and Practice and will cover the principal aspects of a publicly
funded housing practice.
In the context of practical case studies, you will consider
issues in relation to:
- Public sector security of tenure under the Housing Act 1985 and
Housing Act 1996
- Private sector security of tenure under the Housing Act
1988
- Disrepair
- Relevant procedures under the CPR
The content of the full-time and part-time course is identical,
but they are structured differently.
